California law provides significant protections to residents of rental property who are victims of domestic violence or other violent crimes.  The legislature has determined that victims of domestic violence should not lose their housing solely because of abuse or calling for assistance from law enforcement. In November 2017 the San Jose City Council voted to replace the City’s nearly forty-year-old rent control law with a new rent control ordinance. The new Apartment Rent Ordinance (ARO) took effect on December 29, 2017. The new ARO retained the 5% annual rent increase previously permitted, but also adopted many new requirements.

In May 2017, the San Jose City Council also adopted new eviction protections, called the Tenant Protection Ordinance (TPO), which apply to all rent-controlled units in San Jose (and some non-rent-controlled units).

In today’s political climate, all communities are vulnerable to rent control, which has emerged as a popular approach to address rising rents. In 2016 the Mountain View voters approved Measure V, the Community Stabilization and Fair Rent Act (CSFRA), which enacted a system of rent controls and eviction restrictions in the City of Mountain View. The CSFRA took effect on December 23, 2016. Under the CSFRA rent increases for covered units are tied to inflation, as measured by the Consumer Price Index.  The CSFRA also provides protections against eviction for tenants in covered units.

New Proposition 65 regulations for the rental housing industry take effect July 1, 2019. Proposition 65 requires every business with ten or more employees to provide warnings prior to exposing any person to a chemical known to the State of California to cause cancer and/or birth defects or other reproductive harm. The new regulations allow landlords to comply with the law by providing most warnings in the lease or through an annual written notice rather than posting warnings throughout the property. Although California’s eviction protections for tenants with pending rental
assistance applications ended June 30, 2022; Alameda County’s stringent eviction moratorium remains in effect.

Although California’s eviction protections for tenants with pending rental assistance applications ended June 30, 2022; the eviction protections in the City of Los Angeles remain in effect and new protections took effect in many parts of Los Angeles County on July 1, 2022 for those tenants who fail to pay their rent for a COVID-19 related reason and meet certain income requirements. Additionally, there is an ongoing prohibition on no-fault evictions throughout Los Angeles County, with very limited exceptions.

In February 2021, the Sonoma County Board of Supervisors adopted an enhanced eviction moratorium that limit severely limits owners’ ability to remove a tenant from a unit barring special circumstances.

Under the new law, rental housing owners and operators can only recover the unit for health and safety reasons or for the owner to move-in.

If you follow the news, you probably notice that California appears to be in a constant state of emergency. Whether due to fires, severe storms, earthquakes, or pandemics, both the Governor and local officials have declared countless states of emergency over the last several years. Those emergency declarations trigger a provision of the state’s penal code, called the state’s anti-price gouging law, which limits how much rental housing providers can increase rent. And those limitations apply not only to your existing tenants but also to new tenants even in units that are new to the rental market. A violation of this law is a misdemeanor and subject to significant penalties.

Checking credit is a pillar of the screening process, and for good reason. An applicant’s credit is part of the criteria used to evaluate whether they will pay the rent on time. Because of this, it is important for rental housing providers to know what information they can and cannot obtain from credit reports, as well as to understand their legal obligations that come with using consumer credit reports. The use of consumer credit reports is highly regulated under federal law, and there are many potential traps for the unwary.

The COVID-19 Tenant Relief Act of 2020, commonly known as AB 3088, was passed by the California Legislature on Monday, August 31, 2020 and took effect immediately upon signature by the Governor. AB 3088 provides sweeping new protections from eviction for tenants unable to pay rent and other charges due between March 1, 2020 and January 31, 2021 due to circumstances directly related to the COVID-19 pandemic. It also extends the “just cause” protections of the Tenant Protection Act of 2019, commonly known as AB 1482, to all properties through January 31, 2021.

One of the most commonly asked questions on CAA’s Helpline is “Which Addenda Do I Need?” It’s a simple enough question, but there is no one-size-fits-all answer. For 2022, two new addenda are required – a Mold Booklet for all incoming residents and an addendum about recycling for all properties with five or more units.
